  1. GENERAL PROVISIONS
    1. This Internet Shop's privacy policy is for information purposes only, which means that it does not constitute a source of obligations for the Users or Customers of the Internet Shop. The Privacy Policy contains, first of all, rules concerning the processing of personal data by the Administrator in the Internet Shop, including the basis, purposes and scope of personal data processing and the rights of data subjects, as well as information on the use of cookies and analytical tools in the Internet Shop.
    2. The administrator of personal data collected through the Internet Shop is "JEEPMANIA Sp. z o.o.". with its registered office in Wrocław (registered office address and address for delivery: Przedwiośnie 5a Street, 51-211 Wrocław); entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000587297; registration court where the company's documentation is stored: District Court for Wrocław-Fabryczna in Wrocław, VI Economic Department of the National Court Register; share capital in the amount of PLN 0.0000587297; the registration court where the documentation of the company is stored: the District Court for Wrocław-Fabryczna in Wrocław, VI Economic Department of the National Court Register; the share capital of the company in the amount of PLN 0.0000587297: 5 000,00 PLN; NIP: 8952059878; REGON: 36305477600000; e-mail address: sklep@jeepmania.pl - hereinafter referred to as "Administrator" and being at the same time the Service Provider of the Internet Shop and the Seller.
    3. Personal data in the Internet Shop are processed by the Administrator in accordance with applicable law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) - hereinafter referred to as "RODO" or "RODO Regulation".     4. The use of the Internet Shop, including shopping, is voluntary. Similarly, the provision of personal data by the Customer or the Client using the Online Shop is voluntary, subject to two exceptions: (1) concluding agreements with the Administrator - failure to provide personal data necessary to conclude and perform a Sales Agreement or an agreement for the provision of an Electronic Service with the Administrator in the cases and to the extent indicated on the website of the Online Shop and in the Terms and Conditions of the Online Shop and in this privacy policy results in the impossibility to conclude such an agreement. In such a case, providing personal data is a contractual requirement and if the data subject wishes to conclude a given agreement with the Administrator, he or she is obliged to provide the required data. (2) statutory obligations of the Administrator - providing personal data is a statutory requirement resulting from generally binding legal regulations imposing on the Administrator the obligation to process personal data (e.g. processing data for the purpose of keeping tax or accounting books) and failure to provide such data shall prevent the Administrator from performing such obligations.
    5. The controller shall take particular care to protect the interests of the persons to whom the personal data processed by him/her relate, and in particular shall be responsible for and shall ensure that the data collected by him/her are kept: (1) processed in accordance with the law; (2) collected for designated, lawful purposes and not subject to further processing incompatible with those purposes; (3) substantially correct and adequate in relation to the purposes for which they are processed; (4) stored in a form allowing identification of the data subjects no longer than necessary to achieve the purpose of the processing and (5) processed in a manner ensuring adequate security of personal data, including protection against unlawful or unlawful processing and accidental loss, destruction or damage, by means of appropriate technical or organisational measures.
    6. Taking into account the nature, scope, context and purposes of the processing and the risk of any violation of the rights or freedoms of natural persons with varying degrees of probability and seriousness of threat, the controller shall implement appropriate technical and organisational measures to ensure that the processing is carried out in accordance with this Regulation and to demonstrate this. Those measures shall be reviewed and updated as necessary. The controller shall apply technical measures to prevent personal data transmitted electronically from being acquired and modified by unauthorised persons.
    7. All words, expressions and acronyms appearing on this website and beginning with a capital letter (e.g. Seller, Online Shop, Electronic Service) shall be understood in accordance with their definition contained in the Regulations of the Internet Shop available on the websites of the Internet Shop.
  2. THE GROUNDS FOR DATA PROCESSING
    1. The controller shall be entitled to process personal data in cases where - and to the extent to which - at least one of the following conditions is met: (1) the data subject has consented to the processing of his/her personal data for one or more specified purposes; (2) the processing is necessary for the performance of the contract to which the data subject is a party or for taking action at the request of the data subject prior to the conclusion of the contract; (3) the processing is necessary for the fulfilment of a legal obligation incumbent on the Administrator; or (4) processing is necessary for purposes based on legitimate interests pursued by the Administrator or by a third party, except where the interests or fundamental rights and freedoms of the data subject requiring protection of personal data prevail over these interests, in particular where the data subject is a child.
    2.  2.1 of the Privacy Policy. Specific grounds for the processing of personal data of Shop Users and Customers by the Administrator are indicated in the next section of the Privacy Policy - in relation to the given purpose of personal data processing by the Administrator.
  3. THE PURPOSE, BASIS, PERIOD AND SCOPE OF DATA PROCESSING IN THE ONLINE SHOP
    1. Each time the purpose, basis, period and scope of personal data processed by the Administrator results from the actions taken by a given Customer or Client in the Online Shop. For example, if the Customer decides to make a purchase in the Online Shop and chooses to personally collect the purchased Product instead of a courier service, his/her personal data will be processed in order to perform the concluded Sales Agreement, but will no longer be made available to the carrier carrying out shipments on behalf of the Administrator.
    2. The Administrator may process personal data in the Internet Shop for the following purposes, on the following basis, in the following periods and in the following scope:

      The data are stored for the period necessary for the performance, termination or otherwise expiry of the concluded contract.

      Maximum scope: first and last name; e-mail address; contact telephone number; delivery address (street, house number, apartment number, postal code, city, country), residential/business/site address (if different from delivery address).

      In the case of Service Recipients or Clients who are not consumers, the Administrator may additionally process the company name and tax identification number (NIP) of the Service Recipient or Client.

      The stated scope is maximum - in case of e.g. personal collection, it is not necessary to provide the delivery address.

      Direct marketing

      Article 6(1)(f) of the RODO Regulation (legitimate interest of the Controller)

      The data shall be stored for the period of existence of the legitimate interest pursued by the Administrator, but no longer than the period of limitation of claims against the data subject in respect of the Administrator's business activities. The period of limitation shall be determined by the provisions of law, in particular the Civil Code (the basic limitation period for claims related to business activities is three years, and for a sales contract it is two years).

      The Administrator may not process data for direct marketing purposes in the event of an effective objection to this effect by the data subject.

      Data shall be stored until the data subject withdraws his/her consent to further processing of his/her data for this purpose.

      The data shall be stored for the period required by the law requiring the Administrator to keep the accounts (5 years, counting from the beginning of the year following the financial year to which the data refer).

  4. RECIPIENTS OF DATA IN THE ONLINE SHOP
    1. For the proper functioning of the Online Store, including for the performance of concluded Sales Agreements, it is necessary for the Administrator to use the services of external entities (such as a software provider, courier or payment processor). The Administrator shall only use the services of such processors who provide sufficient guarantees of the implementation of appropriate technical and organisational measures so that the processing meets the requirements of the RODO Regulation and protects the rights of the data subjects.
    2. The transfer of data by the Administrator does not take place in every case and not to all the recipients or categories of recipients indicated in the privacy policy - the Administrator transfers data only if it is necessary for the fulfilment of the given purpose of personal data processing and only to the extent necessary for its fulfilment. For example, if the Customer uses personal collection, his/her data will not be transferred to the carrier cooperating with the Administrator.
    3. The personal data of Service Recipients and Customers of the Online Shop may be communicated to the following recipients or categories of recipients:
      1. carriers/forwarders/courier brokers - in the case of a Customer who uses the Online Shop's method of Product delivery by post or courier service, the Administrator shall make the collected personal data of the Customer available to the selected carrier, forwarder or broker executing the shipment to the order of the Administrator to the extent necessary to complete the delivery of the Product to the Customer.
      2. entities handling electronic or credit card payments - in the case of a Customer who uses the electronic or credit card payment method in the Internet Shop, the Administrator shall make the collected personal data of the Customer available to a selected entity handling the aforementioned payments in the Internet Shop on the order of the Administrator to the extent necessary to handle the payment made by the Customer, which may be: a) ING Bank Śląski S.A, b) Twisto Polska sp. z o.o., c) Elavon Financial Services Designated Activity Company (Limited Liability Company with Designated Activity) Branch in Poland, d) Krajowy Integrator Płatności S.A.
      3. service providers who supply the Administrator with technical, IT and organisational solutions enabling the Administrator to conduct his/her business activity, including the Internet Shop and the Electronic Services provided by means of it (in particular, computer software providers for running the Internet Shop, e-mail and hosting providers and providers of business management and technical support software to the Administrator) - the Administrator shall make the collected personal data of the Customer available to the chosen provider acting on his/her behalf only in the case and to the extent necessary for the performance of the given purpose of data processing in compliance with this Privacy Policy.
      4. providers of accounting, legal or advisory services providing accounting, legal or advisory support to the Administrator (in particular an accountancy office, a law firm or a debt collection agency) - the Administrator shall make the collected personal data of the Client available to the selected provider acting on his/her behalf only in the case and to the extent necessary to achieve the given purpose of the data processing in accordance with this privacy policy.
    4. If you provide your personal data in order to conclude a contract with the Online Shop, providing your personal data is a condition for concluding this Contract. Providing personal data in this situation is voluntary, however, the consequence of failing to provide such data will be the inability to conclude a contract with the Online Shop.

      In the event that you provide your personal data for the purpose of transferring your personal data to Twisto Polska sp. z o.o. prior to the conclusion of a contract of sale of goods (or services) purchased in the Internet Shop, the transfer of such data is a condition for the conclusion of a contract of sale in connection with the business model adopted by the Internet Shop.

      In the event that your personal data is forwarded to the Bank in connection with the processing and settlement of payments made by you to the Online Shop via the Internet using payment instruments, the provision of data is required in order to process the payment and to transmit a confirmation of its completion by the Bank to the Online Shop.

      In the event that your personal data is provided to the Bank in order for the Bank to verify the proper performance of the agreements concluded with the online shop, in particular to ensure the protection of the interests of the payers in connection with their complaints, the provision of such data is required in order to enable the performance of the agreement concluded between the online shop and the Bank.

      In the event that your personal data is forwarded to Twisto Polska sp. z o.o. in connection with the possibility of Twisto Polska sp. z o.o. offering to pay the price for the goods or services purchased by you. within the framework of an order agreement including the "Buy with Twisto" purchase formula and making that formula available by the Internet Shop, providing and processing of those data for that purpose is required in connection with the business model adopted by the Internet Shop and for the performance of the agreement concluded between the Internet Shop and Twisto Polska Sp. z o.o.
  5. RIGHTS OF THE DATA SUBJECT
      1. Right of access, rectification, restriction, erasure or portability - The data subject has the right to request from the Controller access to his/her personal data, rectification, erasure ("right to be forgotten") or restriction of processing, and has the right to object to processing, and has the right to portability of his/her data. The detailed conditions for exercising the rights indicated above are indicated in Articles 15-21 of the RODO Regulation.
      2. Right to withdraw consent at any time - a person whose data is processed by the Controller on the basis of expressed consent (on the basis of Article 6(1)(a) or Article 9(2)(a) of the RODO Regulation), then he/she has the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal.
      3. Right to lodge a complaint to the supervisory authority - the person whose data is processed by the Controller has the right to lodge a complaint to the supervisory authority in the manner and mode specified in the provisions of the RODO Regulation and Polish law, in particular the Personal Data Protection Act. The supervisory authority in Poland is the President of the Office for Personal Data Protection.
    Right to object
        - The data subject has the right to object at any time - on grounds relating to his or her particular situation - to the processing of personal data concerning him or her based on Article 6(1)(e) (public interest or tasks) or (f) (legitimate interest of the controller), including profiling on the basis of these provisions. In such a case, the controller shall no longer be allowed to process these personal data unless the controller can demonstrate the existence of compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or grounds for the establishment, exercise or defence of claims.

      1. Right to object to direct marketing - where personal data are processed for the purposes of direct marketing, the data subject has the right to object at any time to the processing of personal data concerning them for such marketing, including profiling, to the extent that the processing is related to such direct marketing.
      2. In order to exercise the rights referred to in this section of the privacy policy, the Administrator may be contacted by sending an appropriate message in writing or by e-mail to the Administrator's address indicated at the beginning of the privacy policy or by using the contact form available on the website of the Internet Shop.
  6. COOKIES IN THE WEBSHOP, USAGE DATA AND ANALYTICS
    1. Cookies are small pieces of information in the form of text files which are sent by a server and stored on the website of the Internet Shop (e.g. on the hard drive of a computer, laptop or smartphone memory card - depending on the device used by the visitor to our Internet Shop).     2. The Administrator may process the data contained in Cookies when visitors use the website of the Internet Shop for the following purposes:
      1. Identify customers as logged in to the Online Shop and show that they are logged in;
      2. remembering the Products added to the shopping basket for the purpose of placing an Order;
      3. storing data from completed Order Forms, surveys or login data to the Online Shop;
      4. to adapt the content of the Internet Shop's website to the individual preferences of the Customer (e.g. as regards colours, font size, page layout) and to optimise the use of the Internet Shop's pages;
      5. to keep anonymous statistics showing how the website of the Online Shop is used.
    3. By default, most web browsers available on the market accept the storing of cookies. You can determine the conditions for the use of cookies via the settings of your own browser. This means that you can, for example, partially restrict (e.g. temporarily) or completely disable the possibility of storing cookies - in the latter case, however, this may affect some of the functionality of the Internet Shop (for example, it may not be possible to follow the path of the Order through the Order Form due to the Products not being remembered in the shopping cart during the consecutive steps of placing the Order).
    4. Your browser settings regarding cookies are relevant for your consent to the use of cookies by our Online Shop - in accordance with the regulations, such consent can also be expressed through your browser settings. In the absence of such consent, the cookie settings of your internet browser must be changed accordingly.

    6. Administrator może korzystać w Sklepie Internetowym z usług Google Analytics, Universal Analytics dostarczanych przez firmę Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Usługi te pomagają Administratorowi analizować ruch w Sklepie Internetowym. Gromadzone dane przetwarzane są w ramach powyższych usług w sposób zanonimizowany (są to tzw. dane eksploatacyjne, które uniemożliwiają identyfikację osoby) do generowania statystyk pomocnych w administrowaniu Sklepie Internetowym. Dane te mają charakter zbiorczy i anonimowy, tj. nie zawierają cech identyfikujących (danych osobowych) osoby odwiedzające stronę Sklepu Internetowego. Administrator korzystając z powyższych usług w Sklepie Internetowym gromadzi takie dane jak źródła i medium pozyskania odwiedzających Sklep Internetowy oraz sposób ich zachowania na stronie Sklepu Internetowego, informacje na temat urządzeń i przeglądarek z których odwiedzają stronę, IP oraz domenę, dane geograficzne oraz dane demograficzne (wiek, płeć) i zainteresowania.
    7. Możliwe jest zablokowanie w łatwy sposób przez daną osobę udostępniania Google Analytics informacji o jej aktywności na stronie Sklepu Internetowego - w tym celu można zainstalować dodatek do przeglądarki udostępniany przez firmę Google Inc. dostępny tutaj: https://tools.google.com/dlpage/gaoptout?hl=pl.
  7. POSTANOWIENIA KOŃCOWE
    1. The Internet shop may contain links to other websites. The Administrator encourages to familiarise oneself with the privacy policy established there after having visited other websites. This privacy policy applies only to the Administrator's Internet Shop.
